These Terms of Service govern your access to and use of the WrittenWords website, web app, iOS app, backend services, and related features.

This draft is written for review before launch. Replace any bracketed items before publishing.

Agreement to These Terms

By creating an account, accessing WrittenWords, or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use WrittenWords.

References to "WrittenWords," "we," "us," and "our" mean WrittenWords LLC, the operator of WrittenWords.

Your Content

"Your Content" means journal entries, uploaded images, OCR corrections, notebook information, and other materials you submit to WrittenWords.

You keep ownership of Your Content. These Terms do not transfer ownership of Your Content to us.

You grant WrittenWords a limited license to host, store, copy, process, transmit, display, modify for technical formatting, generate OCR or embeddings from, and otherwise use Your Content as needed to provide, secure, support, and improve the service.

This license ends when Your Content is deleted from our active systems, except where retention is required for backups, security, legal compliance, dispute resolution, or provider retention periods.

Your Responsibilities

You are responsible for Your Content and your use of WrittenWords. You agree not to:

WrittenWords is designed for personal journaling and personal archive use. High-volume, automated, commercial, or abusive use may be rate-limited, suspended, or require a separate agreement.

Sensitive Content

Journals can contain deeply personal information. WrittenWords is not designed as a regulated medical, legal, financial, or government recordkeeping system.

Do not use WrittenWords as the only copy of information you are legally required to preserve, or as the sole storage location for critical records.

WrittenWords does not provide medical, legal, financial, mental health, or other professional advice.

Privacy and Security

Our Privacy Policy explains how we collect, use, store, and share information. By using WrittenWords, you agree that we may process information as described in that policy.

WrittenWords uses backend-managed encryption for journal text and uploaded journal images in production before storage, but it is not end-to-end encrypted and is not zero-knowledge. Our backend needs access to journal content to provide features such as OCR, search, sync, exports, support, and security operations. Some metadata, including titles, notebook information, dates, page numbers, search embeddings, OCR review metadata, image metadata, and usage records, may not be encrypted with the same content-encryption process.

You are responsible for deciding whether WrittenWords is appropriate for the sensitivity of the content you choose to store.

AI Features

WrittenWords may use AI systems to provide OCR, image understanding, doodle or margin-note extraction, embeddings, and semantic search.

AI features may send Your Content to third-party AI service providers, including OpenAI, as described in the Privacy Policy.

AI outputs can be inaccurate, incomplete, or misleading. You are responsible for reviewing OCR text, generated descriptions, tags, search results, and any other AI output before relying on them.

We do not guarantee that OCR will perfectly preserve handwriting, formatting, dates, page order, names, drawings, or meaning.

Subscriptions, Payments, and Taxes

Some features may require a paid subscription or usage-based plan. Prices, features, limits, and renewal terms will be shown before purchase.

If you subscribe through the web, payments may be processed by Stripe or another payment processor. If you subscribe through the iOS app, purchases may be processed by Apple and subject to Apple's payment, cancellation, and refund rules.

Subscriptions may renew automatically unless canceled before the renewal date. You are responsible for any taxes, fees, or charges associated with your purchase.

Except where required by law or by the applicable app store or payment provider rules, payments are non-refundable.

Usage Limits and Fair Use

We may apply limits to storage, OCR pages, upload size, search, API requests, or other resource-intensive features. We may change limits to protect reliability, manage cost, prevent abuse, or reflect plan changes.

If usage is unusually high, automated, abusive, or outside ordinary personal journaling use, we may throttle, limit, suspend, or require a different plan.

Beta and Pre-Release Features

Some features may be labeled beta, preview, experimental, or pre-release. These features may be less reliable, may change without notice, and may be removed.

Use beta features at your own discretion.

Exports and Backups

Where export features are available, you may export copies of Your Content. You are responsible for maintaining your own backups of important content.

We do not guarantee that WrittenWords will be available without interruption or that data loss will never occur.

Deleting Your Account

You may request deletion of your account by contacting us. Deletion is intended to remove your journal entries, notebooks, uploaded images, embeddings, OCR metadata, and account records from active systems within 30 days, subject to legal, security, billing, backup, fraud-prevention, and dispute-resolution retention needs.

Deletion may not immediately remove data from third-party provider logs, payment records, app store records, backups, or systems governed by their own retention policies.

WrittenWords Intellectual Property

WrittenWords, including our software, design, branding, logos, text, workflows, and other materials, is owned by WrittenWords or our licensors.

These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use WrittenWords as provided through the service. You may not copy, modify, distribute, sell, lease, or exploit WrittenWords except as allowed by these Terms or applicable law.

Feedback

If you send us ideas, suggestions, bug reports, or other feedback, you grant us permission to use that feedback without restriction or compensation to you.

Third-Party Services

WrittenWords relies on third-party services for authentication, payments, AI processing, hosting, storage, diagnostics, app distribution, and other functions. Your use of those services may be subject to their own terms and policies.

We are not responsible for third-party services we do not control.

iOS App and Apple Terms

If you download WrittenWords from the Apple App Store, Apple is not a party to these Terms and is not responsible for WrittenWords or its content.

Your use of the iOS app must comply with Apple's App Store terms and usage rules. If Apple processes your purchase, subscription management and refund requests may need to be handled through Apple.

Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you where applicable.

Service Changes and Availability

We may update, modify, suspend, or discontinue all or part of WrittenWords at any time. We will try to provide reasonable notice for material changes that negatively affect paid users, but we may make urgent changes without notice for security, legal, or operational reasons.

We do not guarantee that WrittenWords will always be available, error-free, secure, or uninterrupted.

Termination

You may stop using WrittenWords at any time.

We may suspend or terminate your access if:

After termination, some sections of these Terms will continue to apply, including sections about Your Content, payments owed, intellectual property, disclaimers, liability limits, disputes, and general legal terms.

Disclaimers

WrittenWords is provided "as is" and "as available."

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

Limitation of Liability

To the fullest extent permitted by law, WrittenWords and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, or cost of substitute services.

To the fullest extent permitted by law, our total liability for any claim relating to WrittenWords or these Terms will be limited to the greater of:

Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules.

Dispute Resolution

Before filing a claim, you agree to contact us at support@written-words.com and try to resolve the dispute informally. We will do the same where practical.

If we cannot resolve a dispute informally within 30 days, disputes will be resolved in the state or federal courts located in Tennessee, unless applicable law requires a different forum.

You and WrittenWords each waive the right to a jury trial to the extent permitted by law.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the app, by email, or by another reasonable method before the changes take effect when required by law.

If you continue using WrittenWords after updated Terms take effect, you accept the updated Terms.
